Account Registration and Verification (KYC/AML) You must provide accurate, complete, and current information. ARKA may request additional documentation to comply with: Canadian Anti-Money Laundering (AML) regulations FINTRAC requirements International FATF standardsKnow-Your-Client (KYC) obligations We reserve the right to approve or reject any application at our discretion. 4. ARKA LTD is not a bank and does not provide insured deposit accounts. Services may involve regulated prime brokers operating within their respective jurisdictions. 5. Market Risk DisclosureTrading leveraged instruments involves significant risk of loss. You may lose the entirety of your allocated capital. Past performance does not guarantee future results. 6. Permitted Use and Restrictions You agree not to: Use the Platform for illegal activities, fraud, or money laundering Engage in spam, phishing, or deceptive practices Reverse engineer, decompile, or copy proprietary code Upload malicious software 7. Intellectual Property All Content is owned by ARKA LTD or its licensors and is protected under applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and view the Platform. 8. Fees, Performance Targets, and Payments Fees, spreads, and performance targets are disclosed on the Platform and may change without prior notice. Payments are processed through third-party providers. ARKA does not store credit card information. Any referenced performance figures represent forward-looking targets and are not guaranteed returns. 9. Disclaimer of Warranties The Platform and Services are provided “as is” and “as available.”We do not guarantee uninterrupted access, accuracy, or specific performance outcomes. 10. Limitation of Liability ARKA shall not be liable for indirect, incidental, or consequential damages. Total aggregate liability shall not exceed the total fees paid by you during the preceding twelve (12) months. 11. IndemnificationYou agree to indemnify and hold harmless ARKA from any claim arising from:(i) breach of these T&C
(ii) misuse of the Platform
(iii) violation of applicable laws
(iv) infringement of third-party rights 12.Termination and Suspension ARKA may suspend or terminate your Account immediately in cases of: Breach of these Terms Fraud or suspicious activity AML violationsIllegal conduct 13. Amendments to the T&C These Terms may be updated at any time. The current version will be available on the Platform.Continued use of the Services constitutes acceptance of the updated Terms. 14. Governing Law and Jurisdiction These Terms shall be governed by the laws of the applicable Canadian jurisdiction in which ARKA LTD operates. Any dispute shall be submitted to the competent courts of that jurisdiction.
